The recommendations and suggestions regarding product application and use that are offered on tepcoproducts.com, in our product brochures, or information provided by any employee, broker or distributor of RTASCo, are a guide in the use of this product and are not a guarantee to their performance since RTASCo, has no control over the use to that other parties may apply the product. RTASCo, recommends that operators and users of our products ensure that the intended use does not violate any Federal, State, or Local law regarding the treatment and disposal of hazardous wastes and associated materials. All disposal of contaminated materials must be in compliance with the Federal, State and Local laws and is the responsibility of the generator.

In no event shall RTASCo or its affiliates be liable for indirect, incidental, special, exemplary, punitive, or consequential damages of any nature including, but not limited to, loss of profits, revenue, production, or use, business interruption, or procurement of substitute goods or services arising out of or in connection with the use or performance of any RTASCo product, whether based on contract or tort, including negligence, or any other legal theory, even if RTASCo or its affiliates has been advised of the possibility of such damages.

RTASCo or its affiliates' total aggregate liability for damages of any nature, regardless of form of action, shall in no event exceed the amount paid by you to RTASCo, or its affiliates for the product upon which liability is based. Some states and jurisdictions do not allow for the exclusion or limitation of incidental or consequential damages, so this limitation and exclusion may not apply to you.
